Parents buying cigarettes for children in Texas

Parents buying cigarettes for children in Texas?
I have a friend who says it's okay to buy her 16 year old daughter cigarettes. We live in Texas and the daughter recently got out of a drug rehab hospital and told her mother that basically the mother can buy her cigarettes or she'll start using drugs again. The mother said it's the lesser of two evils. I say it's illegal, but she says it's not because in Texas you can serve your minor alcohol in your presence. Anyone have any ideas on the law aspect? (Let's stay away from the moral aspect for this question, please). I've looked online and haven't had much luck to prove my case to her. Thank you for all of your answers. From what I can gather, there is no law limiting the age at which someone can smoke, but have to be 18 to purchase. Anyone other than a parent, legal guardian or spouse can buy tobacco for the minor and the minor can only use it in front of the said legal buyer. If the minor is caught with tobacco w/out the legal buyer present, then all applicable fines, classes & restitution apply. I meant to say the only ones who can legally purchase is the parent, legal guardian or spouse. Sorry for the confusion.

Answer 1 :
That's wrong, but I'm not sure about illegal. It's just illegal to buy tobacco under the age of 18, not to use it. :/
Answer 2 :
I honestly don't know the legality of her buying cigs for her daughter. She is right that in TX as long as you're parent is with you, you can get an alcoholic beverage at a restaurant. The restaurant can say no, but they are allowed to serve you. I also, know that in a lot of the hick towns in TX the kids start dipping and smoking cigs at a young age. I know this, because I am from TX and know a lot of people from the small kick towns. I know it doesnt completely answer your question, but I hope it helps!
Answer 3 :
its not illegal to smoke cigarettes just to buy them im from ny and alot of 16 year olds smoke n theres nothing that can really be done
Answer 4 :
it may be wrong but its not illegal. if it was my daughter i would do the same thing...i would rather me know my kid is smoking and limit how many cigs she gets a day then doing drungs or sneaking ciggys from me or someone else
Answer 5 :
smokes too. this is what i have to go by. i was in the army and we had a very young soldier who was 17 and married. by TX law her spouse could buy her booze and smokes. but not by military law. so we prosecuted him. i know there was a bunch of questions going around and we all learned that it is legal in TX. she is the parent and there for the state feels like mother knows best. i know this is stupid as hell but that is what they law is there.
Answer 6 :
Your friend is being blackmailed into getting her daughter cigarettes. You need to tell her that she needs to discipline her daughter more (so that she is the dominant one) rather than obeying her. Possibly even get your friend's daughter a councillor. Lisa.Rr x
Answer 7 :
TERRIBLE.
Answer 8 :
its not illegal for a 16year old to smoke its just illegal for them to buy them

Will my Texas felony probation be revoked by failed drug test

Will my Texas felony probation be revoked by failed drug test?
Ok my charge is Unauthorized Use of a Motor Vehicle. I took my car, which my mother had given me a year prior (She held the title), without her consent and she pressed charges in order to get the law to help straighten me out. I was using marijuana and experimenting with other street drugs at the time, it was really freaking her out. She used the DA to push for rehab, which went through and I recieved 2 years of deferred ajudication probation. So, I was incarcerated for three weeks until these charges and terms were placed on me, yet the DA and Judge both felt the situation at hand wasn't sufficient enough to stick these severe charges to.. Unauthorized Use of a Motor Vehicle is a State Jail Felony. Okay, so far, I have been given 120 hours of community service which I have fully completed, $3,000+ in court/probation fees which I have paid in full, Networking and Budget classes which I have also finished, AA/NA Group Meetings which I am currently in progress with, and six weeks of in-patient rehab which I finished with flying colors and great marks. Now for the things I've done wrong during my 2 year probation.. Early on in my probation, I admited to using alcohol (Stupid...) and then last year this date, I was issued an MIC (Minor in Consumption) on the 4th of July. I was 17 at the time of prosecution, and am now 19 nearly two years later. My relationship with my PO is great, she's younger, alot younger. Everything other than those two bumps in the road has been perfect; I've taken over 50 UA's and have still yet to fail one. But, this time around, if given a UA in the next couple of days, I will. My question is this, will by probation be revoked because of this incident? What kind of strings can be pulled with time served (from when I sat in county before I spoke with the judge, 3 for 1), Rehab (Court Ordered), and nearly all of my probation completed? This is in Tarrant County, Texas.

Title for my speech on Obama's gun control policy and Mexican drug cartel violence

Title for my speech on Obama's gun control policy and Mexican drug cartel violence?
I'm giving an informational speech for my innovations class on a controversial topic that could be further explained. I chose to write about the misconceptions regarding Obama's gun control policy, the claim that many make that the Obama Administration is "taking away our second amendment", and how this is influenced by the Mexican drug wars. My thesis statement is: "Due to misinformation, people often view Barack Obama's policy on firearms as revoking our second amendment, when Obama is actually trying to ban semi-automatic guns to prevent drug war violence in Mexico." I have the speech all outlined, but I'm still in need of a title. Here's the whole outline if you need more information. I. Drug rehab center shooting A. Mexican drug rehab center in Ciudad Juarez raided Sep. 3 (Associated Press writers Ruiz, de la Cruz, and Olson) B. 18 people lined up against a wall and shot C. attacks fueled by American guns (Brady Center to Prevent Gun Violence) D. Obama policy confusion, trying to restrict gun trafficking (Third Illinois 2004 Senate Debate: Barack Obama vs. Alan Keyes, Oct. 21, 2004) II. Describe illegal transport of semi-automatic guns into Mexico A. High-power guns illegal in Mexico, but legal in US after Assault Weapons Ban expired B. Mexican drug cartels cross border into Texas, Arizona, etc. and can purchase bulk shipments of semi-automatic firearms with absolutely no background check. C. US dealers aren't prosecuted for these sales under protection of a bill passed in 2005. (Vote number 2005-219 prohibiting lawsuits against gun manufacturers on Jul 29, 2005 regarding bill S 397 Protection of Lawful Commerce in Arms Act Results: Bill Passed, 65-31) III. Clarify Obama gun policy and treaty with Mexico A. We need "a comprehensive approach" while "also making sure we are dealing with the flow of drug money and guns south.... The drugs are coming north, we're sending funds and guns south." - President Barack Obama, on violence in Mexico, March 2009 (Maria Recio, Obama weighs deploying National Guard on border, Fort Worth Star -Telegram, Mar. 12, 2009) B. Obama supports banning the sale and transfer of all semi-automatic firearms, including semi- to fully-automatic conversion kits (1998 IL State Legislative National Political Awareness Test Jul 2, 1998) C. 1994 Federal Assault Weapons Ban passed by Congress after masses of gun shootings occurred. Ban specifically named 19 types of semi-automatic guns as well as any copy of these. This ban expired in 2004 and Obama is fighting for its renewal. (Coalition to Stop Gun Violence: Assault Weapons Frequently Asked Questions) IV. Bring up new interesting point and restate thesis A. Obama not trying to revoke second amendment, but restricting semi-automatics to reduce drug cartel violence B. Policy could be a “wedge issue”, something used to split apart a political group. People often hear only part of the story, such as “Obama is taking away all of our guns” without hearing all the information. This can be used to immediately set voters against Obama because of a mis-stated phrase.

Answer 1 :
I don't agree with your thesis. But I won't go into it because this isn't the place. I'll try a title anyway. "President Obama's War on Illegal Guns and Drugs" ""Obama Lends a Hand and Sends a Message" Good luck anyway! I'm glad you're taking a serious look at current events and putting some thought into them.
Answer 2 :
Brady Center to Prevent Gun Violence? You're kidding right? Don't even think of using them as a source.
Answer 3 :
NICE! I don't know what the title should be but I would be interested in reading it. Gun control or no gun control in America? I could care less. I don't live in America, but I would really like to prevent American guns from coming into my country. I would really like to read your thesis to know about the facts of gun trafficking.

I need to know if there are any drug rehabs in Brownwood, Texas that will take people with dual diagnosis

I need to know if there are any drug rehabs in Brownwood, Texas that will take people with dual diagnosis.?
My friend has a brother whom she thinks has dual diagnosis. She knows for a fact that he does heroin, but she's not sure if he's really depressive. Their parents are away, and she's asking me to help her find a rehab for him because she thinks this would be the best thing to do for her brother. She's bent on finding one that will take patients with dual diagnosis, as she says that they're better equipped at handling patients with even just a slight psychological problem.

Answer 1 :
I think the best thing for your friend to do would be to bring her brother to a doctor to get him checked up. This way, she will know if he really does have dual diagnosis. The doctor can also tell her then about what kind of treatment program would be right for her brother and which drug rehab will be able to provide her brother with this kind of program. Nevertheless, I included links below that will help you out in your search.
