I am 16 and I am hoping for my mother to get custody of me rather than my father but there are some problems

I am 16 and I am hoping for my mother to get custody of me rather than my father but there are some problems?
My mom has a history of drug addiction but has gone through rehab and has been of probation for about six months. My father moved out of state and cannot return because he is remarried. Do you think the judge will give custody to my mother even though her past is not the greatest? This is in the state of texas by the way. Thanks!

Honestly idk what the Judge will do, i'm shure you will have a say in this, if your comforable living with your mother, then they should just leave it be. (hopefully ;)
Answer 2 :
it is your choice. but.. the fact the ur mother has had an addiction problem they might want to check on her often to see if she is able to care for you.
Answer 3 :
16 might make you legally old enough to choose, check up on your state laws.
Answer 4 :
nope maybe your dad will let you smoke pot in the house goodluck
Answer 5 :
You (usually in the courts eyes) are old enough to tell them how you feel and where you want to live. My advice is write a letter to the judge (submit it through family services or the lawyer). Tell him how she has impacted your live in all positive aspects as possible and how you will benefit from living with her (future plans and goals in the area she lives in- to better your and her life) and how moving with your dad interrupts all your plans. If you need to dish some dirt on your dad stating why you don't want to live with her (he doesn't support your dreams, future goals, etc.) Good luck! I hope this helps!

Well,I have been through this manyy times! In all actuality, the judge doesn't care about what you want. The judge will do whatever seems best. To him it doesn't matter what seems better to you or your mom,he is going to look at your moms charges and say what he thinks. Hope this helps(: -SpidermanSilly(:
Answer 7 :
At 16 you can go to the court and talk to the judge and have that judge change your custody. It is your right at this point. In most states, the age of self-determination of custody is 14. Make sure your mom is up to having custody of you. If she can't provide a stable home life, you don't need to be there because you would actually be a greater burden for her, and thus add to her stress. This really has to come down to what is the most stable home life for you. This isn't about getting away from your dad's new wife. You only have 2 years until you are 18, so you might as well follow through with your education and start holding a part-time job and save some money so you can launch right after you graduate.

can someone over 18 (under 21) be forced into rehab

can someone over 18 (under 21) be forced into rehab?
i have a family friend that has been in and out of rehab for cocaine and heroin and is now over 18... is there any way to get court ordered rehab for this person(texas)? she recently got a dui and is under 21. i know texas has a zero tolerance for that. will she be put on probation? or will the just take her license from her? i know for a fact that she would fail a drug test if she was put on probation. what can her family do... they tried once to put her in rehab after turning 18 but she checked out right way. thanks in advance for any help you can lend.

Answer 1 :
Yes by the court
Answer 2 :
Unless she breaks the law and, as part of her probation or sentence is court ordered to enter rehab, she is free to do as she chooses. She will eventually end up in that situation. For heroin? Very few people get off of that. There's no lifelong addiction - they just end up overdosing at some point after going in and out of rehab a zillion times. She has to get help for her emotional and mental health problems first (depression and self-esteem) then enter a detox program. If she's afraid of withdrawl, get her the psychological help now with no judgments and help her find a rapid detox program. The addict is asleep and under watch during withdrawl. It's quick and easy but if she hasn't received the psychological help then it will be pointless. Please remind her and offer to go with her to a Narcotics Anonymous meeting. They are all over the world with daily meetings and it's possible to go several times a day if she needs to. They ask only that when an addict is there that they want to change. So if you have to haul her there and she's high, that's generally still acceptable as long as she doesn't promote or encourage use while there. Someone should go with her for awhile especially if she smokes. Court appointed attendees often use smoke breaks to buy, sell, and use. Then they turn in their sheet that says they went to the meeting when in actuality they stayed outside and smoked cigarettes the entire time. :/
Answer 3 :
For legal situations, this is possible. You should contact your local authority's office especially since it involves a dui charge. The most effective way is to stage an intervention and try to get her into an appropriate drug rehabilitation facility. Addiction can be a treacherous thing and I wish the best for you and your family.
